What Is the Motorcycle Lemon Law in California?

California’s Lemon Law, officially known as the Song-Beverly Consumer Warranty Act and the Tanner Consumer Protection Act, is designed to protect consumers who purchase or lease new vehicles, including motorcycles, that fail to meet quality and performance standards. If your motorcycle is still under the manufacturer’s warranty and has a defect that substantially impairs its use, value, or safety, you may be entitled to relief under the Lemon Law.

To qualify, your motorcycle must have a defect covered by the manufacturer’s warranty that has not been fixed after a reasonable number of repair attempts. The defect must be one that substantially impairs the value, safety or use of the vehicle. Although the law does not specify how many times you have to bring your bike in for repair before you have a lemon law claim, there is a presumption your machine is a lemon if any of the following circumstances occur within the first 18 months or 18,000 miles after you took delivery of your motorcycle:

  • At least two attempts for serious safety issues
  • At least four attempts for other problems
  • Your motorcycle has been out of service for repairs for more than 30 cumulative (not necessarily consecutive) days

  1. Replacement: The manufacturer may replace your defective motorcycle with a new one that is substantially identical to the original.

  2. Refund: Alternatively, you can opt for a refund of the purchase or lease price, including taxes, registration fees, and any other related expenses. The manufacturer may deduct a reasonable usage fee based on the miles driven before the first repair attempt.

  3. Cash Settlement: In some cases, you may negotiate a cash settlement that allows you to keep the motorcycle while compensating you for the diminished value due to the defects.
